Caleb Fairley Still Seeking New Trial

Fairley, jailed for the murder of Lisa Manderach and her one year old daughter Devon, is reportedly appealing a judge's decision to turn down his last appeal to overturn his 1995 conviction.

 

According to The Mercury, convicted murderer Caleb Fairley is not giving up on his crusade for a new trial after both his court-appointed attorney and a judge said the appeal has "no merit." 

Reportedly representing himself, Fairley has now filed with Pennsylvania Superior Court appealing the Montgomery County judge's latest ruling to deny a new trial. Fairley is requesting a new trial, and that his previous sentence be vacated. Failing that, Fairley reportedly wants a new sentencing hearing.

Fairley is basing his request on a ruling by the U.S. Supreme Court finding mandatory life terms for juveniles unconstitutional. Fairley, who was 21 at the time of the murder, argued that recent appellate court findings support the idea that "a person’s biological process is typically incomplete until the person reaches his or her mid-twenties."

Farley strangled 29-year-old Lisa Marie Manderach, of Limerick, and her 19-month-old daughter Devon, while they were shopping at his parents' "Kidz & Mine" clothing store in the Collegeville Shopping Center on Sept. 10, 1995. He was convicted of first-degree murder in April 1996 and received two consecutive life sentences.

"...wants a new sentencing hearing." I understand the death penalty was given up in exchange for his help in finding the bodies. However, in a new hearing, would that agreement still be binding? He may get more than he bargained for.

I would hope so John. If anyone deserves a slow and painful death it is this piece of garbage. What is even more frustrating is that he is in protective custody in prison which is a shame as I am sure they would have out some of their own justice.
