Fight Doesn't Break Up in Time for 21 y/o Public Drunkeness Offender

A 21-year-old male identified as Kyle Niemann was allegedly taken in for public drunkeness last Wednesday after a couple called police after Niemann attacked Andrew Stein. The crime was committed at 158 Bayberry Drive. Officers John Cassel, Jr. and Kevin McGuigan responded to the call and arrived at a house down the street where they picked up Niemann and a friend, later identified as Stephen Burnett.

As was told by Stein and girlfriend Angelia Goharty, who were both sober, Stein came into the development to pick up Goharty when the two males were standing outside of his car.

"What? Were you trying to clip me?" said Niemann to Stein. "Do you want to go?"

Stein exited his vehicle and said he did not want to fight, but Niemann persisted. Niemann then pushed Stein, swung his legs at him and took him to the ground, trying to choke him. Goharty called police and Niemann walked away. Stein was seen with cuts and scrapes but denied medical attention.

Another friend of Niemann's, Timothy Staranowski, was found later. He told police he had to walk away to cool off. Staranowski also told police he was trying to pull Niemann off of Stein the whole time. Goharty confirmed this as correct.

Upon speaking to Niemann, Officer Cassel detected alcohol on his breath, along with slurred speech and staggering. Niemann's BAC was found to be .187-percent, while Burnett's was at zero. Burnett was not involved in the situation at all.

Throughout the investigation process, Niemann continued to be disorderly toward police, getting up from the curb multiple times and continuously putting his legs outside of the police car when handcuffed. Niemann was taken to Pottstown Police Department and was released in the morning.
