Godin checked the area and the complaintant directed him to Washington Street near Lewis Road. He witnessed the male walking toward a vehicle traveling westbound on Washington toward 9th Avenue.

"The vehicle swerved into the oncoming lane of traffic to avoid striking the male," Godin said. "I then pulled up next to the male and identified him as Ian McCully, a known heroin user through prior contacts. I requested him to put his hands on his head for a pat down search. McCully was incapable of following simple commands and was slurring his speech. His pupils were pinpoint."

When able to respond to simple commands, Godin said McCully was cooperative. Godin then asked him if he had any weapons on him and he reached into his pocket and grabbed a knife, to which Godin was able to get the knife from McCully and disarm him.

While continuing the pat down McCully was asked if he had anything that would poke Godin and he stated two needles in his left sock. The needles were capped and retrieved. He was then placed into custody. Godin returned to the station for a complete search, due to McCully having multiple layers of clothing on.

Upon removing McCully from the vehicle, Godin found "a baggie of green botanical matter, with my training and experience I could state that it was not unlike that of marijuana." It tested positive for marijuana.

McCully was charged based on Godin's findings.
