Disorderly Conduct Issued for Possession of Digital Scale

On May 13 at 8:11 p.m., Officer Tom Godin reported he was on routine patrol when stopping a vehicle for a traffic violation. Upon approach and speaking with the driver, Godin said he became alerted to the driver continuously reaching for his right pocket.

"The vehicle did smell of stale marijuana," Godin said. "As I got the driver out of the vehicle and patted him down for weapons I noted the passenger side map door had what appeared to be a gun handle sticking out of it. I requested Officer Oberholtzer to get the passenger out of the vehicle and pat him down."

Godin went over and retrieved the handle which was a handle to an emergency brake for the vehicle. Godin then asked the driver if any guns and weapons were in the vehicle. The driver said no. A consent search revealed a digital scale under the passenger side front seat and no other contraband was located, according to the police report.

"The scale had green botanical matter on it consistant with marijuana and it smelled of stale marijuana," Godin said. "The passenger immediately stated the scale was his scale. No other drugs or paraphernalia was located inside the vehicle."
