UPDATE: Officer Injured in October Drug Raid Escape

New reports indicate an Upper Providence officer was injured when Justin Mastroianni escaped from police custody.

According to the Affidavit of Probable Cause, new charges have been added in the case against Justin Mastroianni, who was on multiple drug charges on the night of Oct. 7, escaped police custody, and was later in the early morning hours of Oct. 8.

The report told the story of Mastroianni's escape, which revealed that an Upper Providence officer was injured in the process. A warrant was out for the arrest of both Justin, 21, and Nicholas, 22 for drug-related charges from an that began in January.

Upper Providence Officer Michael Schwartz saw Justin leave his residence at 41 Orchard Ct. in his Chrysler Le Baron and was subsequently stopped on the 422 eastbound ramp at Township Line Road. Officers handcuffed and arrested him.

At that time, Upper Providence Officer Jeffrey Hilt arrived on scene to assist in the arrest. He took custody of Justin's wallet and other property that was on his person. As he was being placed in Officer Hilt's vehicle, Justin complained to Hilt that the handcuffs were too tight and that he had sharp pains in his wrist.

Hilt then transferred Justin from handcuffs to Officer Schwartz's prisoner's belt, and then placed new handcuffs on him. They were double-locked and checked for proper fit. Hilt again began to place Justin into his police car.

While being placed in the police car, Justin complained again, but this time that he was feeling sick to his stomach and told the officer to hold on. He then breathed heavily and was spitting on the ground. This was around the time that Norm's Towing Company arrived on scene to transport the Le Baron to the police station.

Justin was finally placed into the vehicle and Hilt began transporting him to the station. En route, on 422, Justin again said he felt sick to his stomach. Officer Hilt told him to hang on, but Justin kept complaining, saying he might throw up all over the back seat of the car. Hilt pulled over and notified other officers of the issue.

Hilt and Justin stepped out of the vehicle and Justin allegedly pretended to throw up, stuck his fingers down his throat and spat on the ground. It is reported that Hilt maintained a firm grip on his shoulder. Justin turned toward the officer and made a comment on how he was gripping him, but Hilt said he was still in custody and would not let him go.

It was at this point that Justin bent over the guardrail on the shoulder of the road to pretend to throw up, then threw himself over the guardrail. Hilt maintained his grip still and tried to pull Justin back over the guardrail, but Justin resisted heavily and pulled him over the guardrail.

The two rolled down a steep embankment through heavy underbrush and "picker" bushes. Hilt lost his grip on Justin and Justin ran away. Hilt reported he was chest-deep in the picker bushes and called for backup.

It was later determined that this occurred 0.0436 miles west of mile marker 181.8 of 422 East.

Hilt's injuries included:

  • Pain
  • Stiffness
  • Scratches
  • Abrasions to both knees
  • Bleeding on the right hand
  • Pain in the right shoulder
  • Minor Scrapes
  • Cuts to the forearms

Limerick, Royersford, Pennsylvania State, Lower Providence and Upper Providence police all were called to assist, along with a North Coventry K-9 unit and a Philadelphia Police Chopper.

At 10:39 p.m. the CMERT team served its search warrant and Nicole Mastroianni and her boyfriend were detained at the residence at 41 Orchard Ct.

At 11:22 p.m., police responded to a disturbance at 42 Orchard Ct., where Shawn Slawecki was allegedly drunk and slapping his sister Aubrie and her friend Deidre Magolon. The girls ran out of the house and told the officers what was going on. Meanwhile, Slawecki was in the rear of the home and threw a glass bottle at a CMERT officer.

Slawecki then came outside and, according to the report, started arguing with officers in front of the house. He was taken into custody.

Meanwhile, officers located and arrested Nicholas, who was at a friend's house at 9 Orchard Ct. Nick and Slawecki were housed at Lower Providence Police Department. During the time of Slawecki's arrest, CMERT officers saw Justin behind 42 Orchard Ct., but he ran and got away.

During the raid, police found the following items of note in the house:

Justin's Bedroom

  • Five plastic packets of marijuana
  • A digital scale
  • A sandwich bag of marijuana
  • Two bottles of anabolic steroids
  • A syringe
  • A pipe for smoking marijuana
  • Eight small packets of heroin
  • Two daggers

Nick's Bedroom

  • A black 12-gauge shotgun
  • Three 12-gauge slugs
  • Two bottles of anabolic steroids
  • Syringes

First Floor

  • Two knives
  • An ammo belt

Officer Schwartz returned back to the station around 3:00 a.m. on Saturday morning, Oct. 8, with evidence and conducted a search of Justin's Le Baron. Police found in the vehicle:

  • Five individual bags of marijuana
  • A used syringe
  • A court document in his name
  • Various pieces of jewelry and a cell phone, allegedly with documented text messages about selling marijuana and heroin

At 4:17 a.m., police observed Justin entering his back yard and tracked him down in a foot chase behind 42 Orchard Ct., where he was attempting to enter.

Officers took custody of Justin, who was in possession of the handcuffs, the prisoner's belt - owned by Upper Providence police - and a cell phone, which is owned by someone in the Slawecki family. Justin told police that he went into the house and stole the phone.

The report states he sarcastically told police that he could go in the Slawecki house whenever he wants because they are close friends.

Josh Slawecki, who was sleeping at the time Justin broke in and took the phone, told police that Justin is welcome in the house, but not when people are sleeping or not home.

Justin's preliminary hearing is on Nov. 1 at 10:00 a.m. His previous charges are still pending, and additional charges added include:

  • Felony: Escape (422 at S. Lewis Road)
  • Misdemeanor: Theft by unlawful taking or disposition (handcuffs worth $40, police belt worth $50, cell phone worth $200)
  • Misdemeanor: Receiving stolen property (same three items from bullet two)
  • Misdemeanor: Loitering/Prowling at night
  • Misdemeanor: Recklessly endangering another person (Officer Jeffrey Hilt injured as a result of the highway escape)
  • Felony: Burglary (entered 42 Orchard Ct.)
  • Felony: Criminal Trespass (at 42 Orchard Ct., which is owned by Todd Slawecki)

Patch was also notified that Nicholas Mastroianni's prelminary hearing was Oct. 18 and he was released on $50,000 unsecured bail. No new charges were added to the original list.
